2. Purpose of the Platform

SFINDEX operates a business-to-business company and industry directory that indexes, stores, and publishes company profiles in order to improve the digital visibility, discoverability, and networking of businesses in Switzerland and abroad.

3. Data Collected

A) Company Data (Non-Personal)

Company name, address, industry, services, opening hours, images, website links, keywords.
(These data are not considered personal data under the Swiss Data Protection Act but are processed with the highest level of care.)

B) Personal Data (Only if included in a company profile – relevant under data protection law)

Name, email address, and telephone number of business owners or official company representatives.
Contractual data for premium listings (digital consents, communication history).

C) Automatically Collected Data

IP address, browser data, usage statistics, cookies, and tracking signals used to improve the platform.

4. Legal Basis for Data Processing (Swiss FADP)

Personal data are processed in accordance with the Swiss Federal Act on Data Protection (FADP), in particular:

• Art. 6 FADP – Lawful processing

• Art. 7 FADP – Principles of data processing (proportionality, purpose limitation, transparency)

• Art. 8 FADP – Disclosure abroad

• Art. 9 FADP – Protection of sensitive personal data (not primarily relevant for SFINDEX, but taken into account if applicable)

Additional legal basis: consent of the company or company representative in the case of premium contracts.

5. Data Transfer & Storage Abroad

SFINDEX stores data globally, including in third countries outside Switzerland and the EU. International data transfers are protected by:

• Standard Contractual Clauses (SCC) pursuant to EU GDPR Art. 46

• Additional end-to-end encryption for sensitive data transfers

• Secure hosting and cloud infrastructure with role-based access control

SFINDEX does not sell personal data. However, it may trade company data, data licenses, and digital register information domestically and internationally, provided a corresponding B2B license or data trading agreement exists.

6. Premium Membership & Data Consent

Premium listings may include:

• SEO optimization of the company profile

• Ranking advantages within the industry directory

• Extended presentation (logo, images, services, keywords)

• B2B profile indexing in Switzerland and abroad

By entering into a contract, the customer expressly consents to:

• Storage and processing of listing data

• Digital marketing-related processing

• International indexing and display within the SFINDEX network

7. Cookies, Tracking & Consent Banner

The platform may use cookies and tracking tools to analyze and improve company rankings, including:

• Visitor statistics

• Search behavior

• Platform performance analysis

Such data are processed only if the user actively consents via the consent banner (opt-in). Users may refuse or delete cookies at any time via their browser settings.

8. Data Retention & Deletion

Requests for deletion of personal data are processed within 30 days, unless statutory retention obligations apply.

9. Data Subject Rights

Any natural person appearing in a company profile has the right to:

• Access stored data

• Rectification of incorrect data

• Deletion of personal data, unless legal obligations prevent it

• Withdrawal of previously given consent

10. Disclaimer

SFINDEX does not guarantee:

• Direct business success, leads, or contracts

• Absolute accuracy of automatically indexed company data

• Content provided by third parties

Liability for damages arising from the use of the platform is excluded to the extent permitted by law.

SFINDEX applies industry-standard and enhanced security measures, including:

• SSL encryption

• End-to-end data encryption

• Backup and recovery strategies

• Role-based access control

• Protection against bots, scraping abuse, and data leaks
